1) Hosting Accounts:

Monthly Charged Accounts:
All our monthly payment hosting plans are backed by 30-days unconditional money back guarantee.  We work hard to offer best service and value to you, our customers and to keep you satisfied, nevertheless, should you decide to discontinue your hosting service with us, we will refund you your first 30 days of service charges minus any set-up fee.  After initial 30 days your monthly hosting charges are non-refundable.

Lets work some numbers out:  If you signed up with us on June 20^th 2000, you are eligible for a complete refund until July 19^th, 2000 minus any setup fee.  Beginning July 20^th 2000, you are charged every month on the 20^th, for next month of service and you are liable to pay for that month of service.

Non-Monthly Payment Plans:
All our non-monthly payment hosting plans are backed by 30-days unconditional money back guarantee.  We work hard to offer best service and value to you, our customers and to keep you satisfied, nevertheless, should you decide to discontinue your hosting service with us, we will refund you your non-monthly hosting service charges minus any set-up fee.  After initial 30 days of your hosting account activation, you are liable to pay for the period you signed up for.

For example, If you have signed up for one year of pre-paid hosting service, we will refund you your payments (minus any or all setup fee) if you cancel your service within 30-days of your hosting account activation with us.  After the initial 30 days you are liable to pay us for the complete year of service.  Under yearly plan we charge you every year for the next year of pre-paid service and you are liable to pay for that period.

Lets some numbers out (yearly payment account): If you signed up with us on June 20^th 2000, you are eligible for a complete refund until July 19^th, 2000 minus any set up fee.  On and after July 20^th 2000, you are liable to pay for the complete one year of hosting service.  Beginning June 20^th next year, that is 2001, you are charged for next complete year of service and you are liable to pay for that year’s service unless you cancel before on or before June19th, 2001 (in this example) or switch to another payment or product plan or both.

2) Domain Registrations:

            Domain name registrations are non-refundable once the registration is processed and entered into registry’s database.

3) Website development or Web Designing:

            All web designing or development costs are subject to $400 or 25% cancellation fee, which ever is higher plus charges for work that has already been completed and all applicable charges, such as late payment and/or collection service charges.   Website development agreements are customized for individual projects.  Please contact us for further information.

We do not host adult oriented web sites, sites that practice Spam, public download sites or sites with any illegal content.  Please make sure that your web site does not come in these categories before signing up.

By using our services in any matter whatsoever, you agree to the following terms and conditions:

ZiberHosting.com will never sell or give away your email address or other information from this database. Your email address is considered contact information for any host names you register. ZiberHosting.com will only provide this information on request to proper authorities.

It is your responsibility to keep your email address current; failure to do so may result in a termination of your account.

Net Abuse Policy

ZiberHosting.com also reserves the right to remove any host name at any time without any warning in response to abuse of the network. ZiberHosting.com defines abuse as anything that is illegal and/or degrades the network such as to affect other users of ZiberHosting.com or the network in general. ZiberHosting.com feels that Spam in any form, including but not limited to, unsolicited commercial email, IRC messages and newsgroup postings is a serious abuse of the network and will not tolerate ZiberHosting.com's name being used in such a way. If you choose to abuse the network or defame ZiberHosting.com in any way, your host name will be immediately deleted and appropriate legal action will follow from ZiberHosting.com, your ISP and the related parties.

Legal
ZiberHosting.com may only be used for lawful purposes. Any use of these services, which violates any local, state, federal, or international laws that may apply to ZiberHosting.com, your local jurisdiction, or any jurisdiction that you or your site may be subject to is strictly prohibited.

You agree to indemnify, defend, and hold harmless ZiberHosting.com from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting directly and/or indirectly from your use of the service which damages either you, ZiberHosting.com, or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account with ZiberHosting.com.

ZiberHosting.com reserves the right to refuse or discontinue service to anyone at our sole discretion. We may deny you access to all or part of the service without notice if you engage in any conduct or activities that ZiberHosting.com in its sole discretion believes violate any of the terms and conditions contained herein. ZiberHosting.com shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor any responsibility for any consequences resulting from such discontinuance or lack of notification.

ZiberHosting.com makes no warranties or representations of any kind for the services being offered. The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non infringement, or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by ZiberHosting.com or its agents or employees shall create a warranty.

ZiberHosting.com provides no warranty that the service will be uninterrupted or error-free. We assume no liability, expressed or implied, for any downtime for any reason.

If you are dissatisfied with ZiberHosting.com or any of its terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the service.

ZiberHosting.com reserves the right to monitor any and all communications through or with our facilities. You agree that ZiberHosting.com is not considered a "secure communications medium" for the purposes of the ECPA, and that no expectation of privacy is afforded.

You agree that you as the person legally responsible for the use of the URL to which your host name points and are at least 18 years of age or have your parent's or legal guardian's permission before using our service.

You agree to adhere to these system policies as published online at along with any documents specifically linked with that document and mentioned as part of system policy, including restrictions on services available with each account type, restrictions on certain features, and all other policies designed to protect and enhance the quality and reliability of service at ZiberHosting.com. You agree to abide by any and all future ZiberHosting.com decisions.

This agreement supersedes any written, electronic, or oral communication you may have had with ZiberHosting.com or any agent or representative thereof, and constitutes the complete and total agreement between the parties.

If any provision of this agreement is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect and said provision shall be reformed only to the extent necessary to make it enforceable.
